AIMPLB endorses Darul Uloom's diktat in rape case
LUCKNOW, JUNE 27 (PTI)
The All-India Muslim Personal Law Board (AIMPLB) today put its stamp of approval on Islamic seminary Darul Uloom Deoband's ruling that the woman, who was allegedly raped by her father-in-law in Muzaffarnagar, cannot be allowed to live with her husband any longer.
"As per the Quran, Imrana's conjugal relationship with her husband stood dissolved since she has been raped by the latter's blood relative," the Board's lone woman member Begum Naseem Iqtedar Ali Khan told reporters here while endorsing the diktat.
Had she been raped by anyone other than a blood relation, she could have stayed with her husband as in the Bilkis Bano case of Gujarat.... But here a sacred relationship had been violated, the consequences of which have to be borne by Imrana and her husband Noor Ilahi, Begum said.
However, the responsibility of the couple's five children would have to be shouldered by Ilahi as long as required, she pointed out adding Imrana also had the right to marry anyone other than her father-in-law's family members.
On whether the punishment was not too harsh for the innocent victim, she said "As believers of Islam, we have to follow what has been prescribed by the religion and even the victim and her husband have professed to abide by Shariat."
The Board, however, strongly condemns the heinous act and wants that the harshest punishment, as per the law of the land, be given to the accused Ali Mohammad so as to set a precedent, she said. The Shariat prescribes stoning a rapist to death but the punishment cannot be given in India as it was not an Islamic country, the Begum said adding hence, the Board wanted the government and the judiciary to ensure that the accused be dealt with an iron hand as per the laws of the land. She assured that the Board, in association with NGOs and other social welfare organisations, would ensure that Imrana was provided with all the monetary and moral support required for her rehabilitation.
Maulana Khalid Rasheed, another Board member, said the AIMPLB had received the 'fatwah' today after which Begum Ali spoke to other senior members and decided to meet the press to iron out misunderstandings in the matter.
Our demand from the government is to institute capital punishment for rapists to curb this serious crime against women, Rasheed said.
Mufti Habibur Rehman of the Darul Uloom Deoband had said in a ruling yasterday that Imrana's living with her husband Noor Ilahi had become untenable as per Islamic law after the alleged rape.
The rape took place in Charthawal town of Muzaffarnagar district on June 4 last after which accused Ali Mohammad was arrested.
The All-India Muslim Women Personal Law Board president Shaista Amber had denounced Deoband's ruling yesterday and claimed that no Quranic injunction justified the verdict.

its so tough to seperate religion and law in our country...
to some the fear of god is the only law....

i don't know what to say about that judgement!
 
It is true in many countries including US. But that does not give authority to violate women.Ok, may be a compromise..let her be debarred from living with her husband, fathr-in-law hanged and since muslim law board is so keen, let it support her for the rest of her life..justice right...
